The census shows John W. born between 1780-1785.

William Smith Sr. was first indicted 2 seperate counts of fighting in Giles County Dec. 9, 1844. He was indicted with his grandson Stephen Smith. He was fined $2.50 plus court costs. He like Stephen were to remain in the county jail if their fines were not paid.

William's second court appearance occured on August 10, 1848. He was indicted for fighting again. He plead guilty. He was fined and released. He had been in a fight with Andrew J. Higgins.

2.  LEMUEL2 SMITH (JOHN WILLIAM SR.1) was born December 1799 in Tennessee, and died May 10, 1854 in Limestone Co. AL.  He married DEBORAH BIRMINGHAM Abt. 1820 in TN, daughter of CALEB BIRMINGHAM and RACHEL UNKNOWN.

Lemuel Smith makes a deed trust with William and James M. Birmingham. It states that Lemuel is in debt to William Birmingham. He is also in debt to James and D. H. Abernathy, merchants in the town of Elkton. He entrusts to James M. Birmingham the following items to settle his debts. If the debt is not settled by Feb. 1, 1838, James M. Birmingham is instructed to sell at public auction to the highest bidder the items to pay off debt to James and D. H. Abernathy in Elkton and William Birmingham.

Notes for JAMES FRANKLIN 'TRICKY JIM' SMITH:
In 1863 he entered the army, joining Wharton's brigade and Malone's battalion, but remained only a short time, when he returned home.

Tricky made a legend for himself. He is said to have buried his money around on his farm. He said that he could sit at his table and see where his money was buried. While he was having his tombstone placed at the New Grove (Nebo) Cemetery it is said that he placed money in his head stone. People have several times since bored into his head stone and looked for the money with no luck. He is rumored to have had money lying around his home and was found and returned by his hired hands. Most people think that he placed this money to check the honesty of his hired hands. The farm he once owned has been the focus of several treasure hunts over the last 75 years. As of this day no one has found Tricky's gold.

4.  MILTON SIMPSON3 SMITH (ROBERT CLOVIS2, JOHN WILLIAM SR.1) was born February 14, 1833 in Lincoln Co, TN, and died January 09, 1907 in Ardmore, Limestone Co., AL.  He married (1) POLINEA GATLIN November 27, 1851 in Limestone Co., AL, daughter of ISAAC GATLIN and MARGARET UNKNOWN.  He married (2) SARAH A HALL 1878.

Milton enlisted as a Private in the 44th Tennessee Infantry, Company F, on the 7th of December 1861, at Camp Trousdale, Tennessee. This camp was located in what is now Gallatin, Tennessee. As in many instances, the Confederacy records are incomplete or were lost/destroyed. The copies located for Milton are for the 1861 enslistment and subsequent reenlistment in December of 1862.

The oral information handed down through Milton's descendants tell he was still in the army when the war ended. Milton's oldest son, S. B., who died the 20th of November 1934 told his grandchildren, "My Pa had to walk home from North Carolina, when the War Between the States ended. Pa said he got so thirsty crossing the mountains and could find no water. Then he happened upon a large mud-hole from which a hog was just leaving. He got down and drank from the mud-hold and had neer tasted before or since such good water." -- Info on the war was taken from the Book "Confederate Soldiers of Limestone County, AL, Lest We Forget" by Jerrye Todd Austin, page 136.

Milton Smith was appointed guardian for Sally Mitchell minor heir of John Mitchell decd, Feb 3, 1868. Signed Milton Smith, R. C. Smith, and Nathan Smith. Lincoln County Court Minute Bk 1866-68.

The Milton Smith farm is located at the dead end of either the Bayless or the Minnie Brown Road. There was once a store here owned by Mr. Sam Hall known as LOAFER'S JOY.

This farm was the old Lewis and Ella Puckett Ferguson farm. Grady & Mable Mitchell (1986) now own this farm.
